General Terms and Conditions

These "General Terms and Conditions" govern the usage of the website and the purchase and sale transactions conducted through the online store located at www.santa-sarah.com. The website is owned by "Santa Sarah  Family Wine Estate".

"Santa Sarah Family Wine Estate" provides customers with the opportunity to purchase goods available in the online store by placing an order and making the corresponding payment.

Customers can place valid orders for the purchase of goods and services offered in the online store only after agreeing to these "General Terms and Conditions".

The seller reserves the right to modify these "General Terms" at any time, and such changes will become effective upon their publication on the website. If a customer disagrees with the changes, they may express their disagreement by sending a statement rejecting the changes to the email address genowski@santa-sarah.com.

Changes to the "General Terms" do not affect the existing relationship between the customer and the seller that arose from a valid purchase request submitted prior to the changes.

Definitions:

The seller refers to "Santa Sarah Family Wine Estate".

Data about the seller: "Santa Sarah Family Wine Estate" is a commercial company registered in the Commercial Register at the Registration Agency, with EIC: BG102243774. The company's headquarters and management address is 2 Ivailo Street, Goritsa Village, Pomorie Municipality, Burgas Region, 8225, Bulgaria. The company is represented by the owner, Ivailo Genowski, and offers goods for sale through the online store www.santa-sarah.com.

www.santa-sarah.com is a website designed for online buying and selling of goods and services provided by "Santa Sarah Family Wine Estate". 

"Goods" and "Services" refer to:

• Wine products as defined by the Wine and Spirits Act;
• Events and tastings;

Each product available on www.santa-sarah.com is accompanied by its name (as it appears on the product label), price in Bulgarian leva or euro (unit price and price per box for purchases of 6 or more products).

"Order" refers to a customer's request to purchase goods from the online store. 

The "Customer" or "Buyer" can be a natural or legal person who has placed an order or registered a customer profile on www.santa-sarah.com and agrees to the "General Terms and Conditions." By placing an order, a natural person confirms that they are at least 18 years old. The supplier reserves the right to refuse an order if there are doubts about the customer's age of 18.

A "Customer profile" contains information about the customer, such as name, surname/trading company, address, telephone, email, EIK/BULSTAT (identification numbers), etc. The supplier stores this information for the purpose of processing orders and providing services.

By using the website, you acknowledge that you are responsible for maintaining the security of your account and password. The customer profile is accessible through a username and password and allows customers to view and edit their registration data, access information about their orders, and change their password. The buyer is responsible for all activities that occur using their password or account. "Santa Sarah Family Wine Estate"  is not liable for losses or damages resulting from the customer's failure to fulfill their responsibilities and obligations under the "General Terms."

To purchase a product or use a service offered on the website, you must register and provide the requested information. By entering any information on the website, you represent and warrant that: 

1. You are at least 18 years old.

2. You are using your actual identity.

3. You have provided true, accurate, current, and complete information.

4. You will promptly update the information to keep it true, accurate, current, and complete.

Order Process: 

When placing an order or registering, the customer provides the following information: for natural persons - name, surname, telephone, address, and email; for legal entities - trading company, EIC, VAT number, telephone, address, email.

The customer follows these steps to place an order:

• Selects the desired products and adds them to the shopping cart by clicking the "Add" button.
• Proceeds to the shopping cart to review the selected products.
• In the shopping cart, the customer determines the type and quantity of goods and confirms the order by clicking the "Finalize the order" button.
• If the customer is a new user, they register by providing necessary information (email address, first name, last name, telephone, delivery address) and choose the payment method.
• f the customer is an existing user, they log in to their account and can review and modify the delivery address and phone number, as well as choose the payment method.
• The customer confirms the requested data by clicking the "Register" button.
• The order is considered made after clicking the "Finalize the order" button.
• If an order/request contains incomplete, incorrect, or wrong address and/or telephone number information, it is considered invalid, and the seller is not obligated to fulfill it.

Order Acceptance: 

The Seller accepts the purchase order by sending a message to the Customer's email address. The message includes the Seller's name, management address, email address, and contact information, as well as information about the requested goods (main characteristics, sales price, transport costs included in the final sales price), payment method, specified invoice data, and delivery address. The request becomes effective after confirming the availability of the goods and validating the order through the provided contact phone number or email address.

Delivery:

The requested goods are delivered to the Customer's specified delivery address by the partner courier company "ECONT." The delivery cost is calculated automatically based on the number of bottles and the delivery address using the courier company's module. Please note that a bottle is considered to be approximately 0.75 liters or 1.5 kg. Deliveries are limited to the territory of Bulgaria.

For delivery outside the territory of Bulgaria, additional charges and individual conditions apply. If you are interested in purchasing goods for delivery outside Bulgaria, please contact us at genowski@santa-sarah.com.

All delivery costs are payable additionally at the time of ordering through myPOS (Payment by credit/debit card). The delivery price is not included in the product price. Orders are delivered within a maximum of 3 (three) working days within the country. Deliveries are made from Monday to Saturday at noon, in accordance with the working hours of the courier company. 

The goods are appropriately packed for transport and handed over to the Customer or a third party who accepts and confirms receipt of the goods on behalf of the Customer by signing the accompanying documents. If the Customer is not available at the specified address within the delivery period or if access and conditions for delivery are not provided, the Seller is released from the obligation to deliver the goods. The Customer can request re-delivery after the initial delivery period, bearing the costs of re-delivery.

In the event that the requested goods are not available, the Seller notifies the Customer within 24 hours of receiving the request via phone call or email. In such cases, the Seller refunds the value of the ordered item(s) or changes the order according to the Customer's request. 

Prices and Payment Method:

All prices of goods on the online store www.santa-sarah.com are in Bulgarian levs (BGN) with VAT for the Bulgarian version and in euros (EUR) with VAT for the English and German versions.

The price includes the value for 1 bottle/unit or 1 item (for tastings and events) as described in the online store. Shipping costs are not included in the prices. The total amount of the order, including delivery costs, is due and payable at the time of ordering.

The payment can be made using the following methods:

Credit or debit card: VISA, VISA Electron, MasterCard, MasterCard Electronic, Maestro, V PAY

Please note that V PAY or MasterCard Electronics cards are accepted only if they are registered to participate in the Verified by Visa or MasterCard SecurityCode online authentication schemes. Additionally, ensure that your card has been enabled by your issuer for online transactions.

 Return of Goods, Compensation of Cardholders, and Cancellation of Orders:

The Buyer has the right to withdraw from the contract within 14 days from the date of receiving the goods, without incurring any compensation or penalty and without stating a reason. However, this right of withdrawal does not apply to certain cases, such as the delivery of goods that cannot be returned due to their nature or the risk of deterioration (e.g., food and drinks), or if the Buyer has unpacked or opened the goods, affecting their quality or quantity.

If the Buyer exercises their right of withdrawal, the Seller will refund the full amount paid within 14 days from the date of withdrawal. However, the return of the goods is at the expense of the Buyer. The Buyer must provide a written statement to the Seller at their address or via email (genowski@santa-sarah.com) to initiate the withdrawal process. It is the Buyer's responsibility to store the received goods and ensure their preservation and safety. The goods should be returned within 14 days from the date of withdrawal.

The Seller does not guarantee uninterrupted, timely, secure, and error-free access to the online store, as certain factors may be beyond their control. The Seller is not responsible for issues related to access to the website or the processing of purchase requests caused by circumstances beyond their control, including force majeure events, random events, problems in the global Internet network, or issues with service providers.

The Seller is not responsible for delivery delays caused by the courier company's fault.

When refunding amounts paid via a POS terminal, the refund is processed back to the card used for the purchase.

The content on the website is the exclusive property of “Santa Sarah Family Wine Estate” and should not be modified, rented, leased, loaned, sold, distributed, or used to create derivative works without the express permission of “Santa Sarah Family Wine Estate”.

Protection of Personal Data:

All personal data processed by the Seller in connection with the use of the website are protected in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and the Personal Data Protection Policy of “Santa Sarah Family Wine Estate”. The Seller ensures compliance with data protection regulations and respects the privacy of users.

In matters not covered by these General Terms and Conditions, the provisions of the current legislation of the Republic of Bulgaria apply.
